1. Acceptance of Terms

Welcome to AutoToonify. By accessing or using our website, mobile applications, or any other services provided by AutoToonify (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and AutoToonify regarding your use of the Services. Please read them carefully.

2. Description of Services

AutoToonify provides a platform that allows users to transform photos into cartoon illustrations using artificial intelligence technology. Our Services include image transformation, storage, and sharing capabilities.

3. Account Registration

To access certain features of our Services, you may need to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update this information to maintain its accuracy.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. User Conduct

You agree not to use the Services to:

  • Violate any applicable laws or regulations
  • Infringe the intellectual property rights of others
  • Upload or transmit viruses, malware, or other malicious code
  • Harass, abuse, or harm another person, or to impersonate or misrepresent your affiliation with any person or entity
  • Upload, transmit, or distribute content that is illegal, harmful, obscene, or otherwise objectionable
  • Interfere with or disrupt the Services or servers or networks connected to the Services

  • Use the Services for any commercial purpose without our prior written consent

5. User Content

"User Content" refers to any content that you upload, submit, or transmit to or through the Services, including images, photos, and other materials.

You retain all ownership rights to your User Content. By uploading User Content to the Services, you grant AutoToonify a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in connection with providing and promoting the Services.

You represent and warrant that: (i) you own or have the necessary rights to your User Content; (ii) your User Content does not infringe the intellectual property rights, privacy rights, or other rights of any third party; and (iii) your User Content complies with these Terms and all applicable laws.

6. Intellectual Property

The Services and their contents, features, and functionality, including but not limited to all information, software, text, graphics, logos, images, and audio/video content, are owned by AutoToonify or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

  • Your computer may temporarily store copies of such materials incidental to your accessing them
  • You may store files that are automatically cached by your web browser for display enhancement purposes
  • You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution

7. Subscription and Payments

Some features of our Services require a subscription or payment. By subscribing to our Services or making a purchase, you agree to pay all fees and charges associated with your account on a timely basis and in the currency specified.

All purchases and subscriptions are final and non-refundable, except as required by law or as explicitly stated in our refund policy.

We reserve the right to change our prices at any time. If we change our prices, we will provide notice of the change on the website or by email, at our option.

8. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AutoToonify SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SERVICES DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
